Terms and Conditions - Online Publications
THIS AGREEMENT:
Is between QWERTYWORD LIMITED (“QWL”) of The Library, Danny’s
Court, Odhams Wharf Ebford EX3 OPB Devon, United Kingdom; and the Client.
WHERE UNDER:
(A) The Client asserts and warrants to QWL that:
- he / she is the beneficial owner of the copy of the source material to be published;
and
- he / she holds the author copyright to the said material; and
- the source material is not subject to any undisclosed lien or other third party
claim of interest.
(B). If the Client is not the beneficial owner then the Client, acting as Agent,
asserts and warrants to QWL that
- he / she has authority to transfer the material to QWL as Agent for the beneficial
owner and
- the beneficial owner holds the author copyright to the material and
- which material is not subject to any undisclosed lien or other third party claim
of interest.
(C). The Client shall deliver the source material to the premises of QWL at his
/ her expense.
(D) QWL shall undertake a test scan of the source material and report the result
in terms of time and cost to the Client
(E) QWL shall provide a detailed quotation to the Client based on the publication
specification pre-agreed between the Client and QWL and the number of copies to
be printed
(F) QWL will pay the Client / Agent (as specified) the sum of the Client’s
share of the realised retail prices and such payment shall by made by BGC or by
UK issued cheque within 10 working days of each quarter end.
(G) QWL shall be responsible for the dry secure and safe insured storage of the
material so as to maintain its condition as well as can reasonably be expected to
be achieved over time.
(H) In the event that the book is to be published in a translated format (translated
from the author’s original language) or to be published in a dual language
format then that process shall be managed by our partner Total Language Solutions
Limited which company shall be responsible in all cases for the sign off of the
QA process and warrants to charge no more than the fees proposed to be charged by
any other company for a translation service.
